Terms & Conditions
These terms and conditions, under the jurisdiction of the Laws of The United Republic of Tanzania, govern the relationship between Nungunungu Company Limited (hereby referred to as “the Company) and the person to whom this itinerary and/or invoice is addressed and accompanying guests included in their itinerary (hereby referred to as “the Client”), to the total exclusion of any other terms and conditions.
No alterations to the terms and conditions may be made by any of the Company’s employees, authorized representative, or agents, unless in writing by a director of the Company. All decisions and matters subject to the Company’s discretion shall be made by a director of the Company.
Bookings
All bookings will require a 30% deposit to be confirmed. Final payment is due eight weeks before the start date of a tour itinerary. Failure to do so will result in your reservation automatically being canceled.
The booking is considered confirmed and accepted by the Company when we forward the confirmation invoice to the Client.
For group tours: The deposit will be refunded if the Company cannot offer you a place. If additional discounts are offered on a per-person basis, the Client should make payment according to the number of confirmed guests at the time and will be refunded any discount owed if additional guests join.
Pricing changes
The Company reserves the right to increase the price of the expedition/ tour/ safari if cost increases arise due to changes in transport costs, accommodations, changes in taxes, customs or other fees, or changes in the exchange rate. We will notify you of changes in costs immediately.
Cancellation & Refunds
Cancellations must be communicated to the Company in writing by email to directors [at] nungunungu dot com and will considered confirmed upon response from the Company indicating receipt of the notification.
> 8 weeks before travel – 25% of the deposit is forfeited
8-4 weeks before travel – the full deposit (50% of total cost) is forfeited
< 4 weeks before travel – 100% of the total cost is forfeited
A portion of the forfeited deposit (minus any irrecoverable costs already incurred by the Company) may be applied as a credit towards a future booking or rescheduled itinerary, subject to the discretion of the Company and its directors.
Any refund owed to the client will be paid by the Company within 60 days of confirmation of the cancellation.
Payment
All deposits and balance payments should be made by wire transfer, online payments, or direct deposit in our bank account (via bank, wakala, or mobile money).
Payments may be made in USD or Tanzanian Shillings, into the respective account.
On receipt of payment, if applicable, we will send vouchers, destination information, clothing lists, etc. Please ensure that you receive this information before you leave on safari.
Reservations & Accommodations
If there are special requests (e.g. special diet, room location, interconnecting/adjacent rooms, king-size beds) that the Client wishes to be accommodated, please advise us when the booking is made. We will pass your request on to the hotel/contracted vendor(s) engaged in the travel itinerary, but cannot guarantee that it will be accommodated.
Hotel check-in/check-out times are fixed and there are no guarantees for early/late check-in/out unless paid for.
Reservations are subject to availability of third-party vendors and properties, especially during PEAK/HIGH seasons if the reservation has not been confirmed. The Company reserves the right to make changes to the itinerary (including vendor, accommodation location and room type), due to changes in availability of third-party vendors and properties.
Please note that reservations cannot be made without a deposit.
The Client must provide copies of passport/national ID for all guests included in the itinerary when confirming the booking. For expatriate residents, please also provide a copy of their valid resident permit. Some reservations cannot be made until these documents are received.
Changes to itinerary
The Company reserves the right to change a program’s dates, itinerary, safari guide or accommodations as conditions warrant. This includes changes due to weather conditions, lodge availability, guide availability, political conditions, and other factors beyond our control without consulting the client. It is understood that such decisions will be made in the best interests of the client and concerning the safety of all guests and staff. The client has no right to any refund or other considerations in the event of these inevitable itinerary or guide changes. If an expedition must be delayed, or the itinerary changed due to bad weather, road conditions, transportation delays, government intervention, sickness, or other contingency for which the Company or its representatives cannot make provision, any additional costs associated with delays or changes are the responsibility of the Client.
Access
The Company shall not be held responsible for road and airstrip conditions, nor changes in flight schedules and availability, which may at times render access to and from travel destination(s) impossible. Any changes made to the initial booking may be subject to additional costs, to be borne by the Client, even if caused by weather, road, or transport conditions.
Risks
The Company draws your attention to the fact that there are certain inherent risks involved in travel to and within Tanzania and sub-Saharan Africa and that the Client and their guests accept them at their own risk. Your itinerary may include rigorous physical activities, travel to remote wilderness environments and/or close proximity to wild animals, therefore it is imperative to follow all safety instructions from your guide(s) and tour leader(s). The Company shall not be responsible for risks arising from circumstances that are out of control of the Company, up to and including injury, illness, or death.
It is the Client’s sole responsibility to take all appropriate medical advice before departure, including whether or not they are fit enough to undertake the trip booked, and the appropriate vaccinations and prophylaxis for destinations included in the itinerary.
We strongly advise that you seek the advice of your own foreign office/state department regarding travel to Tanzania and any other destinations included in your itinerary before embarking on any international travel.
Medical Evacuation & Treatment
Due to the remote nature of many of our travel destinations, we require all of our clients and their guests to have medical evacuation coverage. We include a mandatory supplement of USD 28 per person to all our itineraries for medical evacuation via AMREF (Africa Medical Research Foundation) Flying Doctors - coverage for 30 days in Tanzania, Zanzibar, and Kenya. This supplement may be removed if the Client provides proof of alternate medical evacuation coverage and the policy number(s) and contact information for the Company or its representatives to assist with contacting the medical evacuation provider in case of emergency. For itineraries that do not include travel to remote destinations, the requirement for medical evacuation coverage may be voided, subject to the discretion of the Company and its directors. The Company bears no responsibility for medical evacuation or payment of any medical services, other than to purchase the AMFREF coverage on behalf of the client. We strongly recommend that the Client obtains adequate (international or local) medical insurance to cover any treatment costs in case of a medical emergency. The Client is responsible for confirming whether their policy covers the travel destination(s) included in the itinerary and for payment of any medical services needed. Note that health facilities in Tanzania will not provide service without advance payment (or confirmation of local insurance, if applicable), and the Client should be prepared to pay any medical expenses up-front and out-of-pocket.
Liability & Limitations
The Company acts only as tour operators and agents for the owners, contractors, and suppliers providing means of transportation and/or other related travel services and assumes no responsibility for injury, loss or damage to person or property in connection with any service resulting directly from “Force Majeure” – any circumstance beyond the reasonable control of the Company, including without limitation: acts of God, detention, annoyance, delays, expenses arising from quarantine, strikes, thefts, pilferage, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, terrorism, government restrictions or regulations and discrepancies or changes in transit or hotel services over which it has no control. In case of any Force Majeure, the Company may at its sole and absolute discretion, make reasonable changes in the itinerary, up to and including cancellation, where deemed advisable for the comfort and safety/well-being of the Client, guests, and staff, and/or feasibility of the itinerary.
COVID-19 Terms & Conditions
We understand that travel during this time is subject to additional restrictions and circumstances that are subject to change on short notice. The Client bears sole responsibility for ensuring that they check and adhere to COVID-19 related travel requirements and restrictions in pace for all destinations included in the itinerary.
The Company shall not be held responsible for any losses or expenses incurred by the Client due to factors related to the ongoing COVID-19 pandemic, including but not limited to: delay in receipt of COVID-19 test results, flight cancellations, updated entry/exit restrictions, updated travel advisories, border closures, positive COVID-19 test, quarantine/isolation, or illness/death.
To the extent possible, the Company will make adjustments to the itinerary, postpone travel dates, extend payment credit to future bookings, or allow for cancellation and refunds, in accordance to the extent allowed by these Terms and Conditions.
We strongly recommend that all guests follow their national and international/WHO recommendations for vaccination and prevention measures, in addition to any requirements for travel to which the itinerary is subject.
Travel documents & requirements
It is the responsibility of the Client to obtain and carry a valid passport/ID and any other documents including visas and international certificates of vaccination required for travel to, from and within the travel destination.
It is the responsibility of the client to confirm visa and other travel requirements for all regional and international journeys.
Travel Insurance
We strongly recommend that the Client obtains adequate travel insurance to cover any financial losses due to unforeseen circumstances that may result in changes to and cancellation of the booking.
Dispute
If you have any cause for complaint while traveling, you must immediately bring it to the attention of the Company’s local representative or agent, who will attempt to resolve the situation. Any outstanding dispute will be settled in the Courts of the United Republic of Tanzania, which shall have exclusive jurisdiction thereof.
Consent
The payment of the deposit or any other partial payment for a booking constitutes consent to all provisions of the conditions and general information contained in the terms and conditions. The terms on which the Client agrees to make the booking cannot be changed unless amended in writing and signed by a director of the Company.
